END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“EULA”) is a legal agreement between you (either an individual or an entity) and DigitalDiLeo, the developer and owner of Banana Next Gen (“the Game”). By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA.

If you do not agree to the terms of this EULA, do not install or use the Game.

1. LICENSE GRANT

DigitalDiLeo grants you a non-exclusive, non-transferable, revocable, limited license to use and play the Game solely for personal, non-commercial entertainment purposes on a compatible device.

2. RESTRICTIONS

You may not:

  • Modify, reverse engineer, decompile, or disassemble the Game or any part of it.
  • Distribute, rent, lease, sublicense, or otherwise transfer the Game to any third party.
  • Create derivative works based on the Game without written consent from DigitalDiLeo.
  • Use the Game for any commercial purposes without express permission from DigitalDiLeo.

3. OWNERSHIP

All intellectual property rights, including but not limited to copyrights, trademarks, and trade secrets in and to the Game, are owned by DigitalDiLeo. This EULA does not grant you any rights to ownership of the Game but only grants a license to use it as described in this EULA.

4. USER-GENERATED CONTENT

If the Game includes tools or features that allow you to create or modify content within the Game, such content will be owned by you, but by using these tools, you grant DigitalDiLeo a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, modify, distribute, and display your content in connection with the Game.

5. TERMINATION

This EULA is effective from the date of your acceptance and will continue until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any terms of this EULA. Upon termination, you must cease all use of the Game and destroy any copies of the Game in your possession.

6. DISCLAIMER OF WARRANTIES

The Game is provided “as is” and “as available,” without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. DigitalDiLeo does not warrant that the Game will meet your requirements or that the operation of the Game will be uninterrupted or error-free.

7. LIMITATION OF LIABILITY

In no event will DigitalDiLeo be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use or inability to use the Game, even if [Your Company Name or Your Name] has been advised of the possibility of such damages.

8. GOVERNING LAW

This EULA is governed by and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or related to this EULA shall be brought exclusively in the courts located in [Your Country/State].

9. ENTIRE AGREEMENT

This EULA constitutes the entire agreement between you and DigitalDiLeo regarding the use of the Game and supersedes any prior agreements or understandings.

10. CHANGES TO THIS EULA

DigitalDiLeo reserves the right to modify this EULA at any time. If changes are made, the updated version will be made available, and continued use of the Game will indicate acceptance of the revised terms.

By installing or using Banana Next Gen, you acknowledge that you have read and understand this EULA and agree to be bound by its terms.
